THE CONSTITUTION OF INDIA
WE, THE PEOPLE OF INDIA, having solemnly
resolved to constitute India into a 1[SOVEREIGN
SOCIALIST SECULAR DEMOCRATIC REPUBLIC] and
to secure to all its citizens:
JUSTICE, social, economic and political;
LIBERTY of thought, expression, belief, faith and
worship; EQUALITY of status and of opportunity;
and to promote among them all
FRATERNITY assuring the dignity of the individual
and the 2[unity and integrity of the Nation];
IN OUR CONSTITUENT ASSEMBLY this twentysixth
day of November, 1949, do HEREBY ADOPT,
ENACT AND GIVE TO OURSELVES THIS
CONSTITUTION.
WE have formed this Parliamentary system of Government; The Constitution of India is of the people, for the people and by the people.

“the State’’ includes the Government and Parliament of
India and the Government and the Legislature of each of
the States and all local or other authorities within the
territory of India or under the control of the Government
of India.
BY THE PEOPLE.
YES, we Citizens of India have formed PARLIAMENT and Parliament is of the people, for the people and by the people. Nowadays due to corrupt practices the principle of FOR THE PEOPLE is missing. Even in this case government is too adamant to pass its version of Lokpal Bill which excludes mass corruption from its ambit Most of the political parties are in fright due to Right to Information Act which reveals their corrupt practices. Now they also have apprehension that due to LOKPAL their corrupt practices will be punished within short time without further adjournments and next dates...dates…dates.
During previous fast, the Constitutional authorities – like Prime Minister, Council of Ministers and Government Representatives have urged SHRI ANNA HAZARE to end his fast on the agreement that the LOKPAL BILL would be formulated with joint discussion between Government representatives and Civil Committee member. It was also further agreed that if there are differences on the terms of Lokpal Bill, those terms will be place by Government before Parliament.
HAS GOVERNMENT FULLFILLED ITS PROMISE? NO
Was there any reason for SHRI ANNA to go on fast again? YES
If State i.e. Government - which is administrative authority for our constitution does not keep promises and commits breach of Trust? What remedy citizen has? Is it to approach judiciary? Was it right thing to approach Judiciary? No since there was no formal grievance as it was only “PROMISE”. Therefore Shri Anna Hazare has to go on fast again. There is already a tussle between judiciary and parliament? Judiciary i.e. our Supreme Court & High Court have already upheld constitution and fundamental rights of citizens and ruled that Constitution is supreme and parliament cannot make any law which is unconstitutional.
PARLIAMENT cannot make any law to curtail or restrict Fundamental Rights
Refer Article 13 (2) The State shall not make any law which takes away
or abridges the rights conferred by this Part and any law
made in contravention of this clause shall, to the extent of
the contravention, be void.
Is government justified in proceeding with draft which is publically critized and objected by majority people, Citizens of India? NO. Even if Government proceeds with this Bill, when it receives assent of President and becomes Act, it may be challenged on the ground of Constitutional Validity? since it is unfair and excludes certain officers. The excuse given by Government that large machinery and force will be required for administration of lokpal, is baseless and unwarranted. Is any such machinery required for Right to Information Act? Including all officer, "PUBLIC SERVANT" and even the Prime Minister will have deterrent effect on the individuals and corporates who play role in corruption.
For those who oppose this movement, Do you have answer to your family members questions, if your son/daughter ask you – how do I get justice, Dad? I have been asked to pay donation to college? pay money without fine challan by traffic police? How do I punish government officer who has share in Public Distribution System?
IS Anticorruption Act and its machinery efficient and sufficient to curb big recent corruption such as Commonwealth games, Telecom & Minning Gotalas ? NO
